Council to waive fees for outdoor cafe and pub seating

Kildare County Council is to temporarily waive fees for applications by businesses for permission to use footpaths or public spaces for outdoor seating areas, writes Brian Byrne.

This is part of the authority's effort to support business recovery from the Covid-19 restrictions.

Such structures are permitted under a Section 254 licence from the Council's Planning Department.

While noting that each application will be considered on a case by case basis, the Council has outlined a number of general conditions.

Drawings and dimensions must be submitted with the application, and in the case of footpaths there must at all times be a 2m distance of unobstructed shared space remaining on the path.

No fixed structures will be allowed, and all structures must be removed every night. The applicants will have to show public liability insurance for the area and indemnify the Council.

Licences will be granted for a limited trial period and reapplication will be required for continuing. Any structures without a licence will be removed.

A separate licence will be required if alcohol is to be sold in the space.
