Ballyshannon quarry action adjourned again

The court action by the Ballyshannon Action Group seeking permission to have a Judicial Review of the decision to grant permission for a quarry at Racefield has again been adjourned, writes Brian Byrne.

The proceedings in the High Court first came before the courts in late October when the judge put the Leave Application on Notice. It was adjourned until today, 7 December. This morning the case was further adjourned until 25 January 2022.

Kildare County Council refused planning permission in November 2019 to Kilsaran Concrete for the 32.2 hectare development, on several grounds including traffic hazard/public safety on local road network and loss of amenity to the area.

An Bord Pleanala's own Inspector also recommended refusal, saying the development would 'seriously injure the amenities of properties in the vicinity by reason of traffic, noise, air quality, visual impacts and general disturbance'.

The Bord ignored this recommendation and issued a decision on the appeal on June 10th 2021, allowing for the quarry to proceed.
